Safeguarding the Future: Children's Constitutional Rights

Protecting Children Against State Overreach

The balance between state interests and children's rights is delicate. Unfortunately, state overreach can sometimes infringe upon a child's right to privacy, freedom of expression, and family integrity. To protect these fundamental rights, it is essential to remain vigilant and advocate for laws that prevent government entities from compromising the well-being of children. By fostering awareness and implementing advocacy strategies, Child's Cry for Help works tirelessly to combat overreach and ensure children's voices are heard.

Troxel v. Granville 530 U.S. 57 (2000) case sets the baseline of Constituitonal protection for parental rights.   

The 28th Amendment Protecting Parent Child Bonds freedom from government tyranny and fundamnetal rights. The 14th Amendment's Due Process Clause protects parents rights to raise their children, and states these rights are fundamental. Court imposed higher standard of proof when states terminate parental rights (TPR). Providing minimal reasonable standard of care is parental fitness. Santosky v. Kramer 455 U.S. 745 (1982)
